Signed 26 October 1838

In the name of God Amen I Solomon Tice senior of Washington County and state of Ohio being weak in body but of sound and perfect mind and memory blesed be the almighty God for the same do make and publish this my last will and testament in manner and form following viz.

First my will is that all my just debts and funeral expenses be paid.

Secondly I give and bequeath to my four sons John, James, David and Solomon one equal share and share alike of thee land I now own and all thee rest of my property that I own shall be sold and thee money arisen their from and thee debts due me shall be equally divided amongst my four named sons and equal shair and shair alike...I do allso give and bequeath to my daughter Sarah Newton thee sum of five dollars on demand and lastly I do constitute and appoint my son John sole executor of this my last will and testament hereby revoking all former wills by me made.

In wittness whereof I have unto set my hand and seal this 26 day of October in thee year of our Lord one thousand eight hundred thirty eight.

The State of Ohio
In court of Common Pleas Special Session
December 22 Washington County, ss. A.D. 1838

The foregoing instrument of writing purporting to be the last will and testament of Solomon Tice senŐr late of Ludlow Township in said county deceased was produced in court for probate whereupon Samuel Martin and Nehemiah A. Hearn the subscribing witnesses to the same being sworn severlly depose and say that they saw the said Solomon Tice senior sign said instrument of writing as and for his last will and testament; that he was there of sound mind and memory, over the age of twenty one yers and under no restraint in making said will and that they signed their names as witnesses thereto in the presence and at the request of said testator and also in the presence of each other: and thereupon said will is accepted and approved by the court and together with the probate thereof ordered to be recorded. And on the motion of John Tice the Executor named in said Will and he having taken the oath required by law and, gives bond, with John Medley and Nehemiah A. Hearn his securities in the penalty of five hundred Dollars conditioned, as the law directs Letters Testamentary are granted him ordered, that Samuel Thomas, Jacob Mingett and Elisha Reed do appraise the personal property belonging to said decedents estate agreeably to law.
